Mogul Capital & Finance (ABN 35 767 467 002) (“we”, “us”, “our”) is a Credit Representative (CRN 553226) of Connective Credit Services Pty Ltd (ABN 51 143 651 496), Australian Credit Licence 389328.
We are committed to protecting your privacy. This policy explains how we collect, hold, use, disclose and protect your personal information, and how you can access it, correct it or make a complaint. We handle personal information in accordance with the Privacy Act 1988 (Cth), the Australian Privacy Principles (APPs), Part IIIA of the Privacy Act and the Privacy (Credit Reporting) Code 2014 (“CR Code”).
By providing your information to us, or by asking us to assist with your credit needs, you consent to us handling your information as described in this policy.
The information we collect depends on the service you ask us to provide. It may include:
Identity and contact information — your name, date of birth, residential and postal address, email addresses, telephone numbers, occupation and employer, marital status, number and age of dependants, residency and visa status, and identification documents such as a driver licence, passport or Medicare card.
Financial information — income, expenses, assets, liabilities, bank and credit card statements, payslips, tax returns, notices of assessment, superannuation details, existing loan and repayment details, and details of the property or asset you wish to finance.
Credit information — credit applications you have made, repayment history information, defaults, court judgments, credit scores, credit reports and credit eligibility information obtained from credit reporting bodies or lenders (see section 4).
Sensitive information — in limited circumstances, and only with your consent or where the law permits, we may collect sensitive information such as health information (for example, where illness affects your capacity to repay, or in relation to loan protection insurance).
Website and technical information — your IP address, browser type and version, device information, the pages you visit, referring URLs, and information collected through cookies and analytics tools (see section 9).
If you provide us with information about another person (for example, a co-applicant, guarantor, spouse or dependant), you confirm that you are authorised to do so and that you have made that person aware of this policy.
If you do not provide the information we request, we may be unable to assist you with your credit needs, and lenders may be unable to assess or approve an application.
We usually collect personal information directly from you — through our website enquiry and contact forms, by telephone, email, SMS, video call or in person, through fact-find and application documents, and through client portals or digital document-signing platforms we use.
We may also collect information about you from:
Where we collect your information from a third party, we will take reasonable steps to make you aware of that collection unless you have already consented or an exception applies.
As a credit assistance provider, we may collect and use credit information and credit eligibility information about you. This may include obtaining a credit report from a credit reporting body such as Equifax Australia, Experian Australia or illion Australia.
We may:
We do not supply consumer credit ourselves, and we do not report repayment history information or defaults to credit reporting bodies. Lenders you deal with may do so under their own policies.
Credit reporting bodies may include information about your dealings with us in reports they provide to other credit providers to assess your creditworthiness. You have the right to:
Contact details and privacy policies for each credit reporting body are available on their websites.
We collect, hold and use your information to:
From time to time we may contact you with information about products, services, offers and events we think may be of interest to you, including by email, SMS, post or telephone. We do this in accordance with the Spam Act 2003 (Cth) and the Do Not Call Register Act 2006 (Cth).
You may opt out at any time by using the unsubscribe link in any electronic message, or by contacting us using the details in section 16. We will action your request promptly and at no cost to you. We will not use sensitive information for direct marketing without your consent, and we do not use credit eligibility information for direct marketing.
Opting out of marketing will not stop us sending you communications necessary to the service you have asked us to provide.
We may disclose your personal information to:
We do not rent or sell your personal information.
Some of the service providers we use — including cloud hosting, software and support providers — may store or access personal information outside Australia, including in the United States, the European Union, New Zealand, the Philippines and India.
Where we disclose personal information overseas, we take reasonable steps to ensure the recipient handles it in a way consistent with the Australian Privacy Principles, including through contractual protections. We do not disclose credit eligibility information to overseas recipients who do not have an Australian link, except as permitted by the Privacy Act.
Our website uses cookies and similar technologies to operate properly, remember your preferences, measure traffic and improve performance. Cookies are small files stored on your device. Most browsers allow you to refuse or delete cookies, though some parts of our website may not function correctly if you do.
We may use third-party analytics and advertising tools, which may set their own cookies and collect information about your use of our website. These may include Google Analytics, Google Ads and Meta (Facebook) advertising tools. Information collected by these providers is governed by their own privacy policies.
Our website may contain links to, or embedded content from, third-party websites. We are not responsible for the privacy practices or content of websites we do not operate, and we encourage you to read their privacy policies.
Information you submit through our enquiry or contact forms is transmitted to us and stored in our systems. Email and internet transmission is not completely secure, and you send information to us at your own risk.
We do not make decisions that significantly affect your rights or interests using computer programs alone. Assessments of your circumstances and any recommendation we make are made by a person.
We use software that helps compare and filter credit products and may generate indicative results, and some lenders use automated systems to assess applications. Any decision to approve or decline credit is made by the lender under its own policies. If our practices change, we will update this policy in line with the automated decision-making transparency requirements in APP 1.7 of the Privacy Act.
We take reasonable steps to protect your personal information from misuse, interference and loss, and from unauthorised access, modification or disclosure. These steps include access controls and password protection, secure cloud storage, encryption in transit where available, staff confidentiality obligations, secure disposal of physical documents, and contractual obligations on our service providers.
We are subject to the Notifiable Data Breaches scheme. If we become aware of a data breach that is likely to result in serious harm to you, we will notify you and the Office of the Australian Information Commissioner as required by the Privacy Act.
We keep your information for as long as needed for the purposes described in this policy and to meet our legal obligations. Credit assistance records must generally be kept for at least seven years under the National Consumer Credit Protection legislation, and anti-money laundering records for at least seven years after our relationship with you ends. Some records are kept longer where a loan remains on foot or where a dispute or investigation is on foot. When information is no longer required, we take reasonable steps to destroy it or de-identify it.
You may request access to the personal information and credit information we hold about you, and ask us to correct it if it is inaccurate, out of date, incomplete, irrelevant or misleading. Please make your request in writing using the details in section 16. We may ask you to verify your identity.
We will respond within a reasonable period, and ordinarily within 30 days. We do not charge for making a request, though we may charge a reasonable fee for providing access in some circumstances. If we refuse access or correction, we will tell you why in writing and how you can complain.
If we correct credit information we have previously disclosed, we will notify the relevant credit reporting body or credit provider as required.
Where lawful and practicable, you may deal with us anonymously or under a pseudonym — for example, when making a general enquiry. However, we cannot assist you with a credit application without knowing your identity, and identity verification is required by law.
If you believe we have breached your privacy, the Privacy Act or the CR Code, please contact us first using the details in section 16. Please describe your complaint and how you would like it resolved.
We will acknowledge your complaint promptly and, in most cases, respond within 30 days. If we need more time, we will let you know.
